Reasons
1. Basic facts
A. The parties concerned are corporations operating the D Hospital (hereinafter “Defendant Hospital”), and the network E (hereinafter “the network”) is a person who received treatment from the Defendant Hospital as a primary myelofibsis, and PMF, and the spouse of the deceased and the Plaintiff B are children of the deceased.
나. 망인의 피고 병원 내원과 치료 경과 1) 망인은 건강검진 결과 혈액검사 수치가 정상치를 벗어난 것을 확인한 후 2015. 9. 17.경 서울대학교병원에서 실시한 골수검사 결과 일차성 골수섬유증으로 진단받고, 2015. 11. 18. 확진 및 치료를 위해 피고 병원의 혈액종양내과에 외래로 내원하여 유전자검사를 받았다. 피고 병원 의료진은 망인에 대하여 일차성 골수섬유증으로 IPSS(International Prognostic Scoring System, 국제예후인자)상 호염기구증가와 피부병터가 있는 저위험군으로 진단하고 아스피린과 항히스타민제를 처방하여 외래 추적관찰하였다. 2) 망인은 2016. 2. 17. 피고 병원에 외래로 내원하였는데 2015. 11. 18. 실시한 유전자검사 결과 칼레티쿨린(calreticulin, CALR) 돌연변이가 검출되었고, 2016. 2. 17. 당시 혈액검사 결과 혈색소 14.3(g/dL)으로 정상, 백혈구수 14.15(×103/㎕)로 약간 상승, 혈소판수 250(×103/㎕)으로 정상, 아세포 0(%)이었다.
