The defendant is innocent. The summary of this judgment shall be notified publicly.
Reasons
1. The summary of the facts charged is that the Defendant lent approximately KRW 12 million to C on July 2009 to around July 8, 2009, and the victim D (nive, 80 years of age) is the mother of the above C.
피고인은 2014. 11. 1. 19:00경 군산시 E에 있는 피해자의 집에 찾아가 약 2-30분 동안 혼자 있는 피해자에게 “남편이 돈을 안 받아오면 모시고 오라고 한다, 돈(피해보상금)이 들어왔으니 딸 대신 300만 원도 못 해줘! 나 자고 가려고 마음 먹고 왔어! 나 진짜 꼭지가 돌면 어떻게 할지 몰라! 월요일에 올 테니 돈을 갖고 만나요!”라고 말하고, 2014. 11. 3. 18:40경 다시 피해자의 집에 찾아가 “돈을 찾아 왔냐!, 우선 300만원이라도 달라!”라고 말하고, 2014. 11. 24. 불상지에서 피해자에게 전화하여 “내가 한 번 더 참는 거야, 내가 엊그저께 풀멜 때도 확! 거기서 뒤집어버릴까 어쩔까 하다 내가 참았어요, 며칠 더 기다려 보는데 못받은셈 치고 우세라도 떨겠다.”고 말하고, 2014. 12. 26. 17:30경 다시 피해자의 집에 찾아가 “돈을 주지 않으면 가만두지 않겠다!”라고 말하였다.
The Defendant repeatedly visited an obligor or his related person without any justifiable reason to cause fear or apprehension, thereby seriously impairing privacy and peace in business.
2. Article 15(2)2 and Article 9 subparag. 2 of the Fair Debt Collection Practices Act (hereinafter “Fair Debt Collection Practices Act”) punish a debt collector’s act of seriously impairing his/her private life or peace in business by repeatedly or at night (referring to the period from 9:00 p.m. to 8:0 a.m. on the following day) by visiting a debtor or his/her related person without justifiable grounds.
In order to punish cases where a debt collector visits a debtor or his/her related person at night other than at night, the debtor or his/her related person shall be punished repeatedly according to the composition requirements.
