피고인들은 공모하여 2012. 11. 4. 위 사우나에서, H, I, J, K 등 4명(이하 ‘I 등’이라 한다)이 18:30경부터 19:20경까지 그곳 비즈니스룸 특2호실에서 판돈 합계 19,190,000원을 걸고 일명 ‘쎄븐카드(기본 판돈을 내놓고 트럼프 카드 52매를 순서에 따라 1인당 3매씩 나누어 가진 후 카드를 1매씩 추가로 받을 때마다 판돈의 절반 범위 내에서 베팅을 한 후 각자가 가진 카드 7장의 무늬와 숫자를 비교하여 높은 패를 가진 사람이 승자가 되어 판돈을 모두 가져가는 포커게임)’ 도박을 하고, L, M, N, O, P 등 5명(이하 ‘P 등’이라 한다)이 16:00경부터 19:20경까지 그곳 비즈니스룸 특5호실에서 판돈 합계 2,660,000원을 걸고 일명 ‘쎄븐카드’ 도박을 함에 있어, 그와 같은 사정을 잘 알면서도 사우나 영업을 위하여 그대로 묵인ㆍ방치함으로써 위 각 비즈니스룸을 도박장소로 제공하여 영리의 목적으로 도박을 개장하였다.

The instant private house can use the annual fee free of charge at the end of the week, and in such cases, the member shall use the business room at the end of the week.
