All the judgment below against the Defendants is reversed.

Defendants are not guilty.

1. The summary of the facts charged in the instant case is that Defendant B is the president of the F hotel underground wells (the details of business report as of April 23, 2012: the name of the place of business, “G hotel company wells”, and “public bath business” as of April 23, 2012, and the Defendant A is the above private letter or manager.

피고인들은 공모하여 2012. 11. 4. 위 사우나에서, H, I, J, K 등(이하 ‘I 등’이라 한다) 4명이 18:30경부터 19:20경까지 그곳 비즈니스 룸 특2호실에서 기본 판돈을 내놓고 트럼프 카드 52매를 순서에 따라 1인당 3매씩 나누어 가진 후 카드를 1매씩 추가로 받을 때마다 판돈의 절반 범위 내에서 베팅을 한 후 각자가 가진 카드 7장의 무늬와 숫자를 비교하여 높은 패를 가진 사람이 승자가 되어 판돈을 모두 가져가는 방법으로 판돈 합계 19,190,000원을 걸고 일명 ‘쎄븐카드’라는 도박을 하고, L, M, N, O, P 등 5명(이하 ‘P 등’이라 한다)이 16:00경부터 19:20경까지 그곳 비즈니스 룸 특5호실에서 판돈 합계 2,660,000원을 걸고 일명 ‘쎄븐카드’ 도박을 함에 있어, 호실 당 99,000원의 사용료와 카드대금 20,000원을 받고 도박장소와 트럼프 카드를 제공하여 영리의 목적으로 도박을 개장함과 동시에 풍속영업자의 준수사항을 위반하였다.

2. The judgment of the court below

A. Of the facts charged in the instant case, the lower court: (a) based on the evidence of the lower judgment, found that: (a) studio in the studio is a structure open to the entrance and can be sufficiently reported and heard by the people in the studio outside of the studio with due care; (b) there are three to six studio inside the studio of the instant studio; (c) there are three to six studios in the form where studio of the instant studio; and (d) there are adequate facilities for the instant studio for the instant studio because of the green studio; and (e) the employees of the studio or studio receive a card from P, etc. to request for the studio at the time of the instant case
