피고인은 2015. 12. 6. 18:20경 전남 곡성군 C에 있는 D PC방 안에서 옆 좌석에 앉아 있던 피해자 E(36세)이 담배를 피우고 있는 피고인을 향해 흡연실에 가서 담배를 피우라고 말하고, 이를 무시하고 계속 흡연하는 피고인에게 “잠깐 밖으로 나갑시다”라고 하면서 따라 나오라고 하였다는 이유로 화가 나, 피해자의 멱살을 잡고 흡연실로 끌고 들어가 “뭘 나가냐, 니 나이 몇 살이냐”라고 하면서 오른쪽 주먹으로 피해자의 얼굴 부분을 수회 때리고 발로 정강이를 1대 걷어차 폭행하였다.
