피고인은 2015. 7. 11. 23:00경 부천시 소사구 B 피해자 C(24세)가 관리하는 'D' PC방에서 술에 취하여 손님들이 기분 나쁘게 봤다는 이유로 “뭘 쳐다봐”라고 욕설을 하면서 흡연실에 있던 재떨이를 발로 차 쓰러뜨리고 PC방 의자를 걷어차는 등 소란을 피워 위력으로 피해자의 PC방 업무를 방해하였다.
