A defendant shall be punished by imprisonment for not less than two years and six months.
Reasons
Punishment of the crime
1. No person who violates the Electronic Financial Transactions Act shall transfer or take over any access medium in using or managing such an access medium;
Nevertheless, on February 11, 2015, upon receipt of a request from F to introduce and request a person to be transferred by opening and transferring a nominal passbook from F, the Defendant introduced Defendant-type G to F. On February 11, 2015, G established the K and then, around February 16, 2015 in the name of the said company, two accounts (In Nonghyup Bank I, the Industrial BankJ) around February 16, 2015, and one account (In Daegu Bank K) around March 5, 2015. On March 9, 2015, the Defendant transferred the three accounts to F, from the interface of the trade name in the Gu-U.S., the account and cash cards, security cards, OTP creation machines, and the certificate of official approval.
As such, the Defendant assisted the transfer of the access media.
2. On January 1, 2015, the Defendant released money deposited in the account transferred with F, L, M, N,O, P, Q, R, and S, from time to time to time with L, M, N,O, P, Q, R, and S: (a) reported to F when the deposit is confirmed; (b) the Defendant ordered L, M, P, P, Q, R, and S to check the balance of the account from time to time to time; and (c) the Defendant ordered L, M, etc. to check the balance of the account from time to time, and to check the result thereof.
On January 19, 2015, L used to verify that there is a balance in the national bank account (Account Number V) in the name of the UU bank in the name of the KU bank settlement bank and report it to F, and make a repeated entry of a wrong password to suspend the payment of the above account, and F made a withdrawal of KRW 23,120,000 in the above account owned by the person who was in custody as the representative director of the KU at the location of the Gu-U.S. National Bank of America located in the 89 U.S. in the Gu-U.S.-U., Seoul Special Metropolitan City (U.S.) around November 19, 2015.
