Defendant
B A person shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Except as otherwise expressly provided for in any other Act, no person of "2017 Highest 7060" shall transfer any access medium.
1. On October 11, 2016, Defendant A opened two (G and H) bank accounts of F Co., Ltd. at the location of the claim branch office located in Jung-gu Seoul, Jung-gu, Seoul, Seoul, and transferred the passbook, OTP, and password to a person who is not his/her name.
2. On February 7, 2017, the Defendant: (a) opened a bank account with us (J) of us (J) in the bank located in the name of the Defendant Company B; (b) transferred the passbook, OTP, and password of the account to the person in whose name the account was named; and (c) transferred a total of 12 occasions of opening the account between around that time and March 29, 2017, as indicated in the list of crimes in the attached Table, to the same account as indicated in the list of crimes; and (d) transferred a total of 12 times of opening the account at one time during the commercial concurrent relationship.
Except as otherwise expressly provided for in any other Act, no person of "2017 Highest 771" (Defendant B) shall transfer any access medium.
Nevertheless, around July 6, 2017, the Defendant transferred the electronic financial transaction access media by transferring the passbook, physical card, andOTP connected to the National Bank Account (L) in the vicinity of the Green Bank Green in Yeongdeungpo-gu Seoul, Seoul, to the bearer, and transferring the password to the bearer.
Except as otherwise expressly provided for in any other Act, no person of "2018 Highest 730" (Defendant B) shall transfer any access medium.
Nevertheless, on March 21, 2017, the Defendant opened a post office account in the name of M Co., Ltd. (N) at the post office located in the Gyeonggi-do-dong, and transferred the passbook, the OTP, and the password to the person under whose name the account was not opened.
