Basic Facts

당사자의 지위 원고는 부동산 분양업 등의 사업을 영위하는 주식회사이고(갑 제1호증의 1), 피고는 토목건축공사업 등의 사업을 영위하는 주식회사이며, 송도국제도시개발 유한회사(이하 ‘송도국제도시개발’이라 한다)는 인천 연수구 B 외 11필지 총 44,321㎡ 대지에 지하 2층, 지상 4층(1블럭), 지상 2층(2, 3, 4블럭), 연면적 54,725㎡의 C 상업시설(이하 ‘C’라 한다)의 신축 및 분양사업을 시행하는 회사이다.

On February 13, 2009, the defendant entered into a service contract for revitalization of sale in lots and lease with C's contract amount of KRW 18,467,220,000 from February 13, 2009 to March 25, 2010 as the contractor of Songdo from February 13, 2009.

The above service contract was amended three times on December 3, 201, and the final contract term of the above service contract was extended on December 31, 2012 through the third amendment agreement concluded on December 3, 201.

On July 12, 2011, the Defendant selected three companies, including the Plaintiff, as eligible for preferential negotiations on the subcontract for the promotion of sale in lots and lease in lots in C, following the assessment of pule et al. on July 13, 201 to subcontract the promotion of sale in lots and lease in lots.

(A) On September 28, 2011, the Defendant sent a public letter to the Defendant, even before entering into this service contract, stating that the Defendant first promoted services for the lease of the C commercial building at Liland, Inc. (hereinafter “Liland”) prior to the conclusion of this service contract.

(A) On December 7, 2011, the Defendant entered into a contract for the activation of sale and lease (hereinafter “instant service contract”) between the Plaintiff and the Plaintiff from December 7, 2011 to December 19, 2012, namely, the contract amount of KRW 10,836,651,10 (hereinafter “instant contract”).

Among the affairs that the plaintiff should perform in accordance with the instant service contract, it shall be in addition to the services for facilitating sale in lots and lease.
