1. The defendant is based on the transfer on January 12, 1970 of the land indicated in the annexed list to the plaintiff.
Reasons
1. Basic facts
A. A. On September 25, 194, the “Gongneung Repair Association” was established by the former Joseon Repair Association Order (amended by the Decree No. 2 of July 1917, and was repealed by the enforcement of the former Land Improvement Project Act on January 21, 1962), and was merged into the “Yju Repair Association” on December 1, 1961.
Pursuant to paragraph (6) of the Addenda of the former Land Improvement Project Act (amended by Act No. 948 of Dec. 31, 1961, which was repealed by the Agricultural Community Modernization Promotion Act of Jan. 12, 1970), the name of the "Pju Land Improvement Association" was changed to the "Pju Land Improvement Association". The "Pju Land Improvement Association" was enacted by Act No. 2199 of Jan. 12, 1970, and was repealed by Act No. 5077 of Dec. 29, 1995 as the "Pju Land Improvement Association" under Article 3 (1) of the Addenda of the former Farmland Improvement Project Act (amended by Act No. 5077 of Dec. 29, 1995; hereinafter the "former Farmland Improvement Promotion Act").
B. “Paju Farmland Improvement Association” was dissolved by the former Agricultural and Rural Infrastructure Corporation and Farmland Management Fund (amended by Act No. 5759, Feb. 5, 199). The Korea Agricultural and Rural Infrastructure Corporation established on January 1, 200 succeeded to the rights and obligations of the “Paju Farmland Improvement Association” under Article 9 of the said Act.
Under Article 3 of the Addenda to the former Korea Rural Community Corporation and Farmland Management Fund Act (amended by Act No. 7775 of Dec. 29, 2005 and enforced April 30, 2006), “Korea Rural Community & Agricultural Corporation” has changed the name to “Korea Rural Community & Agricultural Corporation,” and “Korea Rural Community & Agricultural Corporation” has changed the name to the Plaintiff pursuant to Article 3 of Addenda to the former Korea Rural Community Corporation and Farmland Management Fund Act (amended by Act No. 9276 of Dec. 29, 2008 and enforced June 30, 2009).
C. On December 30, 1945, the Gongneung Water Cooperative completed the Gongneung reservoir, and the land indicated in the attached list (hereinafter “instant land”) constitutes the Gongneung reservoir, which is either incorporated into or near the Gongneung reservoir as the land category of the instant land is a road, river, or maintenance.
