2. 정보통신망이용 촉진 및 정보보호 등에 관한 법률위반( 음란물 유포) 피고인은 2014. 1. 경에 대전 서구 F 자택 내에서 인터넷 공유사이트 인 큐 다운 (www .qdown .co .kr )에 위 아이디로 접속하여 인터넷 파일 공유 프로그램을 설치한 뒤 ‘ 슈퍼 업 로드’ 라는 자동 업 로드 프로그램을 이용하여 남녀가 출연하여 서로 성기를 드러낸 채 노골적으로 성행위 장면들이 묘사되어 있는 "( 야 비) ( 노) 모든 서비스를 도 맞아 해 온 미녀 엘프 (23) "이란 제목의 음란한 동영상 파일 " 엄청 귀욤 .avi" 을 업 로드하는 등 다수의 음란물 동영상을 불특정 다수의 회원들 로 하여금 다운로드 받아 열람토록 배포하고 이를 공연히 전시하였다.
