피고인들은 2016. 9. 11. 03:15경 대구 중구 공평로 35에 있는 ‘삼덕119안전센터’ 앞 도로에서 피고인 A이 택시운전기사인 F과 실랑이를 하던 중, 피고인 A은 112신고를 받고 출동한 대구중부경찰서 G지구대 소속인 경사 H, 순경 I으로부터 사건경위에 대한 질문을 받았음에도, 이를 무시하고 계속하여 F에게 “싸우자”라고 말하면서 달려들어 위 H으로부터 이를 제지당하고 다시 질문을 받자 화가 나 “경찰 새끼들, 병신 같은 게, 이 좆밥 찌끄래기!”라고 욕설을 하면서 주먹으로 삼덕119안전센터의 닫힌 철제 셔터문을 수 회 내려치며 위협하고, 주먹 등으로 위 H의 가슴 부위를 수 회 밀고, 배 부위로 몸을 밀면서 폭행하였다.
