Reasons
Punishment of the crime
The Defendant is the president of the incorporated association B (hereinafter “B”), which is an institution that performs senior citizens’ job-seeking projects, and was the vice president of D’s election countermeasure headquarters, which was a candidate for the re-election of the National Assembly member in the Magnam-gun District, which was implemented on October 30, 2013.
No one shall make contributions for a candidate in connection with an election.
The Defendant: (a) around October 17, 2013, around October 2013, the Defendant: (b) mobilized senior citizens belonging to D candidates at a public campaign speech meeting place; and (c) ordered them to call for the D candidates; and (d) had the said senior citizens use transportation facilities to move to the public campaign speech place or interview place.
At around 09:00 on October 18, 2013, the Defendant ordered 100 senior citizens belonging to the Nam-gu Office B located in Nam-gu, Nam-gu, Dong-gu, to gather the office by not later than 15:30 next day, requested F to provide tourist buses at around 15:00 on the same day. The Defendant also accepted F.
On October 19, 2013, at around 15:30, the Defendant divided approximately 63 senior citizens, including H, who are f3 people in front of the “G bath” B office, into two tourist buses provided by the above F, and followed up by having them undergo an open speech or interview of D candidates in the south-gu I at the port of port, and allowed them to undergo an excessive support of D candidates, such as d candidates’ ties. After the public speech was completed on October 17, 2013, the Defendant returned them again to two tourist buses.
As a result, the defendant made a contribution act of approximately KRW 400,000,000 to about 63 persons in the constituency for D candidates in relation to the election.
