A defendant shall be punished by imprisonment for not less than eight months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On July 11, 2015, the Defendant: (a) from police officers E, F, and G who belong to the police box of the Seodaemun-gu Police Station D that received 112 report while drunkly under the influence of alcohol in Heak-gu B apartment 104, the Defendant was under the influence of drinking at 104, and was under the influence of drinking at 112.

2. 피고인은 2015. 7. 12. 00:00경 경기 용인시 기흥구 보정동 1290에 있는 용인서부경찰서 형사과 사무실에서 제1항의 공무집행방해 혐의로 현행범인 체포되어 있던 중 술에 취하여 경찰관인 H외 2명에게 “씨발놈아 쫄았어 대단하네, 돈을 존나게 벌고 싶나보네, 이 개새끼들아, 나 니네 부모님 이름 아는데 씨발놈아”라고 소리를 지르며 바닥에 침을 뱉고, 계속하여 “병신, 야 병신아, 아우 씨발, 존나 재밌네, 이 씨발놈아, 너 내가 가만히 안 있을 것인데 후회 안할 자신 있어 너 진짜 뒤진다, 안경잡이 새끼 좇나 지랄하네, 악, 악”이라고 소리를 지르는 등 같은 날 03:00경까지 약 3시간 동안 술에 취하여 몹시 거친 말과 행동으로 주정하고 시끄럽게 하였다.

3. On July 12, 2015, the Defendant, at around 03:25, led the body of the Defendant, without any justifiable reason, while being escorted for the purpose of committing the act of obstruction of performance of official duties as stipulated in Article 1(a), from the Yeongdeungpo-dong Police Station Lane, Gandong Police Station, which is located in Gandong Police Station 143, Gannam-ro, Gandong Police Station, to the suspect of obstruction of performance of official duties as stipulated in Article 1(a).
