Defendant
A shall be punished by imprisonment with prison labor for four years and by imprisonment for ten months.
Reasons
Punishment of the crime
Defendant A, from January 2008 to December 21, 2008, operated the travel business, such as the sale of airline tickets, mainly against the Joseon-gu Seoul Metropolitan Government D from D to December 21, 2008.
1. Alteration of an official document;
A. On July 20, 2008, the Defendant, without authority, altered the business registration certificate with regard to F under the name of the director of the regional tax office having jurisdiction over the official document, by drawing up and printing the document in the representative column of the travel business registration certificate for F issued under the name of the regional tax office without authority, with “A” a computer, and copying the business registration certificate.
B. On August 2008, the Defendant modified the travel business registration certificate for G in the name of the head of the Suwon Tax Office by the same method without authority for the purpose of exercising it at the above E office as a patrolman.
2. Exercising altered official documents;
A. On July 2008, the Defendant, at the end of the foregoing E office, exercised an altered official document by presenting the altered business registration certificate as stated in paragraph 1(a) to H as if it was genuine.
B. On August 8, 2008, the Defendant exercised the altered official document by presenting the altered official registration certificate as stated in Paragraph 1(b) at the above E office to an employee in the name-free position at the I travel destination store as if the completion of the revised business registration certificate was authentic.
3. In concluding a contract with H and E sales agency contract with which many other shipbuilding units are known to sell airline tickets in a large quantity, the Defendant: (a) placed at least 100 airline tickets purchase reservations a day, which would increase the amount equivalent to 15% of airline tickets; (b) placed 5,000 won for each case; and (c) placed 10,000 won for each fee; and (d) H would pay 3-4% of airline tickets to the employees if the employees attract the reservation to purchase airline tickets through the Chinese food materials sales shop owner, and the Chinese food materials sales store.
