1. The Defendant (Counterclaim Plaintiff) paid KRW 12,526,00 to the Plaintiff (Counterclaim Defendant) for KRW 12,526,00 and for this, from June 22, 2016 to January 10, 2018.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Facts of recognition;

A. The conclusion of a service contract between the Plaintiff and the Defendant (i) is a company engaged in the manufacture and sale of medication devices, blood speculation devices, etc., and the Defendant is a company specializing in such services as management consulting and examination agency services regarding medical device manufacture, permission, certification procedures, etc.

② On March 31, 2015, the Plaintiff and the Defendant concluded a service contract with the content that the Defendant vicariously performed all duties for obtaining permission to manufacture and sell medical devices for artificial expansion (hereinafter “instant contract”).

3. The main contents of the instant contract are as follows. <1> 1: Blood circuit (A0920.01) for artificial extension (A0920.01) for the purpose of obtaining permission for manufacturing as an agent; 2: The request for simple alteration of procedures, such as the change of packaging units, measurements, and the change of the name of composition: 2: 2: Medical circuit for artificial extension (A020.01) for the purpose of obtaining permission for manufacturing as an agent; 3: 3: The preparation of additional technical documents - the process of testing as an agent for artificial extension (A09.20.01); 3: The request for technical documents for permission for the alteration; 3: the period of validity of new technical documents for artificial extension (A0.0.01); 3: the period of validity of new technical documents for obtaining permission for the extension of technical documents for artificial extension of grade 2; 3: 1.0.1. The applicant for permission for new technical documents for the extension of grade 2: the period of validity of new technical documents for extension of 3: 10 years after the date of permission for new technical documents.
