1. The Defendant shall pay to the Plaintiff KRW 21,90,000 and the interest rate of KRW 15% per annum from April 23, 2016 to the date of complete payment.
Reasons
1. Facts of recognition;
A. On March 19, 2015, the Plaintiff entered into an insurance contract (hereinafter “the insurance contract of this case”) with the insured and the beneficiary as the Plaintiff on the condition that “Aam, Eam, Eam, Eam, Eam, Eam, Eam, and Eam, Eam, Eam, Eam, Eam, Eam, and Eam, at the time of diagnosis and confirmation, the diagnosis and confirmation is 20,000 won of the above insurance amount as “Aam, Eam, Eam, Eam, Eam, Eam, Eam, Eam, Eam, and Eam,” which is “Aam, Eam, Eam, Eam, Eam, Eam, Eam, Eam, to pay 4,000 won of the cancer surgery cost as the insurance amount when the insurance contract of this case was entered into for the direct purpose of the treatment.
The relevant contents are as follows:
Article 3. Definition and Confirmation of Diagnosis. 1. The term 'amam' in this Agreement means the disease except for the disease with the classification No. C44 and the disease corresponding to the malicious life of the skin, and the classification No. C73 from among the diseases specified in the Maternal Life Classification Table (Annex 1). The disease classification criteria are based on the 6th revised Korean Standard Disease Classification.
(5) The diagnosis and confirmation of cancer shall be made by a person with a professional doctor's license of autopsy pathology or clinical pathology, and this diagnosis shall be based on tissue tests, microscopic tests, or current and microscopic tests of blood.
However, if the diagnosis under the above is not possible, I must have a documented record or evidence proving that the insured is receiving the diagnosis or treatment by cancer.
Article 4 Definition and Diagnosis Confirmation of Job Cancer (1) The term "job cancer" in this Agreement means a disease specified in Table 2 attached to the Job Organism Classification Table, and the disease classification criteria shall be in accordance with the 6th amended Korean Standard Disease Classification.
(2) The diagnosis and determination of a place cancer shall be performed by dissecting pathology or disease.
