1. Of the judgment of the court of first instance, the part against the plaintiff ordering payment shall be revoked.

The defendant shall be 13.6 million won to the plaintiff.

Basic Facts

On October 12, 2012, the Plaintiff agreed to enter into a comprehensive insurance contract with the Defendant, an insurance company, and the Korea-China Scambus (hereinafter “instant insurance contract”) for cancer-related purchase amount as follows.

Expenses for cancer diagnosis: 10 million won (less than one year and less than 50 percent of the transitional period): Expenses for cancer diagnosis (less than one year and less than one year): 20 million won (per one surgery, and less than one year, 50 percent in the case of less than one year): The main contents of the relevant special terms and conditions are as follows in the insurance contract of this case:

Article 3 (Definition and Diagnosis Confirmation of "Site cancer") (1) In this contract, the term "place cancer" means a disease (see attached Table 3) classified as a job-based new life in the 6th Korean Standard Disease Death Classification.

Article 7 (Types and Grounds for Payment of Insurance Money) Where an insured person (person subject to insurance) is diagnosed from the date of commencement of guarantee for cancer prescribed in Article 5 (Commencement of Guarantee) after the date of commencement of guarantee for cancer or from the date of commencement of guarantee to "other skin cancer", "Aboard cancer", "Site cancer", or "bratory species" during the insurance period, the following amount shall be determined only once for the first time for cancer diagnosis costs by the beneficiary (person who receives insurance money).
