Reasons
Punishment of the crime
[Criminal Justice] On April 20, 2012, Defendant B sentenced Defendant B to imprisonment with prison labor for fraud, etc. at the Busan District Court on July 30, 2012, and completed the execution of the sentence.
[2014 Highest 3207] Defendants recruited to purchase tax-free goods within the aircraft using a suspended credit card, referring to the fact that the payment of credit cards is made in an aircraft in operation with D without approval.
1. Defendant A and D’s joint criminal conduct orders E (Suspension of Prosecution on May 29, 2014) to take the method of purchasing tax-free goods in the flag against Defendant A, and E, upon such instructions, instructed the Defendant A to purchase the items to be purchased after boarding the aircraft in the Incheon Jung-gu Airport located at the Incheon Airport around September 10, 2013 with Defendant A at the Incheon Airport, Jung-gu Airport, Jung-gu, Incheon, with Defendant A. A and D received goods equivalent to the sum of KRW 12,084,000 from the air of the victim corporation over 23 times in total as described in the attached Table III Nos. 1 through 23 from the above date to September 13, 2013.
Accordingly, the defendant A acquired the victim's property in collusion with D.
2. On December 16, 2013, Defendant B and D’s co-offendered Defendants B board the Incheon International Airport located in Jung-gu Incheon Airport, Jung-gu, Incheon International Airport, with the items to be purchased by Defendant B, and Defendant B requested to purchase tax-free items, such as compact cosmetics, to those who are under duty in the above aircraft.
