A defendant shall be punished by imprisonment for two years.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime
[criminal power] On March 22, 2019, the Defendant was issued a summary order of KRW 3 million at the Suwon District Court on the ground of a violation of the Road Traffic Act (driving).
【Criminal Facts】
1. Around 05:55 on August 28, 2020, the Defendant driven EMW car from the 8km section from the 8km section to the village hall located in Seoan-gu, Seoan-gu, Seoan-si, Ansan City, in the state of under influence of alcohol by 0.216% without obtaining a driver’s license.
As a result, the defendant violated the prohibition of drunk driving more than twice, and at the same time, operated the car without obtaining the driver's license.
2. At around 19:30 on August 28, 2020, the Defendant: (a) reported 112 on the road in front of the community hall located in Asan-si, Asan-si; and (b) discovered as a drunk driving on the road in front of the community hall; (c) reported 112, the Defendant: (d) expressed the name of pro-friendly H in the driver’s statement column in the driver’s statement column of the written statement on the driver’s statement of the driver’s statement; (d) stated the name of H in the name column; and (e) submitted the said G as if it was a document duly formed.
Accordingly, the Defendant, for the purpose of uttering, forged the report on the circumstantial statement of the owner-user under H, which is a private document related to the certification of facts, and exercised the forged private document.
3. The Defendant, at the time and place specified in Paragraph 2, was willing to gather the names of the above H, and the above G entered the results of the drinking driving control by using the National Police Agency PDA, and signed the above PDA as “H”. The Defendant presented forged signature and sent the results of the drinking driving control to the above G to the traffic police network.
