Defendant

A is the representative of “M” who is the owner of the Gu K site in Bupyeong-gu, Incheon, which is entrusted with the removal and management of facilities by L, and Defendant B is the representative of “N” awarded a subcontract for removal works, etc. from “M” and Defendant C and Defendant D are L employees of the company as security guards. Since there is a dispute between “P” and “P” which is the representative of the victim, the Defendants were willing to remove the facilities of the lessee who entered into a lease contract with the above “P”.

1. 피고인 A 피고인은 2013. 7. 초순경 위 K 부지 내 M의 사무실에서, B에게 “Q과 R의 사무실을 부숴야 하니 장비를 알아보고 2013. 7. 7. 06:00경에 사무실을 부숴라”라고 말하여 B로 하여금 Q 등을 부수도록 마음먹게 하고, 그로 하여금 2013. 7. 7. 05:00경 피해자 O 관리의 R 사무실과 피해자 S가 운영하는 Q의 유리창, 벽면 등 시가 합계 1,850만 원 상당의 시설을 부수도록 하여 B를 교사하였다.

2. 3. At around 05:00 on July 7, 2013, Defendant C: (a) at the night of the lodging house and the office used by the victim U in the above K site; (b) at the top of the office, the Defendant shouldered the office glass of the Defendant’s use; and (c) at the network entrance, the office entrance, etc. received from the knife, damaged the property equivalent to KRW 7.8 million at the market price owned by the victim.

4. Around July 7, 2013, Defendant D intruded with the entrance door opened at the house and the office used by the said victim U, and then intruded into the said house and the entrance door.
