A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, “2016 Highest 918”, at the C president’s office located in Jeju-si, around May 2015, entered the written indictment as “F., May 22, 2018” in the written indictment for around May 18, 2015 at the request of D to purchase 83,000 shares of E Co., Ltd. (hereinafter “E”) from D., Ltd. (hereinafter referred to as “E”), but corrected as it appears to be a clerical error.
E’s shareholder F, G, H, and I entered into a share purchase contract with F, etc., for KRW 350 million, and thereafter issued five copies of the share transfer contract with F, etc. and five copies of the share transfer contract with F, etc. for the share certificates of KRW 83,000 received from D.
D and J, on May 22, 2015, entered in the name of K giving 50,00 of the above shares in the name of L, 26,000, 7,000 of L, 7,000 of the above shares, and filled up the column for the transferee of the above shares transfer contract, and separately affixed the seal of the defendant in two copies of the share transfer contract, and made all columns in blank around July 27, 2015.
1. An accusation;
A. On August 10, 2015, the Defendant stated “A” and “K” in the Jeju District District Court’s civil petition office located in the Jeju District Public Prosecutor’s Office located in the five-lane-3, Jeju-si, Jeju-si, the date of which the Defendant applied for a permit to convene a general meeting of shareholders and affixed “A” on the paper for a contract to acquire shares transfer at a non-permanent location, and affixed “A” and “K” on the date of the preparation, and forged A’s seal impression on the name of the transferor, and forged A’s private document transfer contract, which is a private document on rights and obligations, and signed A’s signature on July 16, 2015, and affixed A’s signature on the delegation column and affixed A’s signature on the power of attorney and forged A’s title as a private document on rights and obligations, and completed the power of attorney.
