피고인은 2013. 3. 24. 02:40경 서울 중랑구 B에 있는 ‘C’ 술집에서 술에 취해 행패를 부리던 중 신고를 받고 출동한 서울중랑경찰서 D파출소 소속 순경 E에게 “너 이리 나와 봐 개새끼야, 나랑 맞짱 한번 뜨자, 죽여 버린다, 나이도 어린 좆만한 새끼야”라고 욕을 하면서 손으로 E의 목을 치고 팔로 E의 목을 잡아 바닥에 쓰러뜨리고, 서울 중랑구 F에 있는 D파출소에서 조사를 받던 중 재차 “두고 봐, 너 이 새끼 끝까지 가보자, 목을 따버릴 테다”라고 욕을 하며 발로 E의 허벅지를 찼다.

Accordingly, the defendant interfered with legitimate execution of duties concerning the prevention, suppression and investigation of police officers' crimes.
