1. The defendant shall be punished by a fine not exceeding seven million won;

2. Where the defendant fails to pay the above fine, one hundred thousand won.

피고인은 2013. 3. 20. 15:15 경 위 ‘E 의원 ’에서 피해자 F( 여, 21세 )에게 케타민( 전신 마취제) 0.3cc, 미 다 졸람( 수면 진정제) 2cc 및 1% 리도카인( 국소 마취제) 8cc를 투여한 후 눈 성형수술을 시행하였고, 같은 날 17:15 경 피해자에 대한 코 성형수술 전 수면 마취를 유지하기 위하여 케타민 0.3cc, 미 다 졸람 2cc를 추가 투여하였고, 같은 날 17:37 경 피해자에 대한 코 성형수술을 위해 2% 리도카인 7cc를 투여하던 중 피해자의 얼굴이 부어오르고 캑캑거리면서 숨을 못 쉬는 증상이 나타나자 17:40 경 피해자에게 텍 사 메타 손( 과 민반응 치료제) 1 앰플을 투여하고 수면 마취를 깨우려고 플루 마제 닐( 마취 제 해독제) 1 앰플을 정맥 주사한 후 다시 수술을 진행하려고 하였으나 17:42 경 피해자가 더욱 격렬하게 캑캑거리면서 숨을 쉬지 못하고, 피해자의 눈이 뒤집히고 머리가 뒤로 젖혀져 경련을 일으키며 호흡을 하지 못하는 상태가 되자 119에 연락하고 피해자에게 기관 내 삽 관을 시행한 후, 17:51 경 119 구급 대가 도착하자 피고인이 시행한 기관 내 삽 관을 유지하면서 18:03 경 구급 차에 동승하여 G 병원으로 출발하였고, 18:10 경 피해자는 G 병원 응급실로 옮겨 졌다.
