1. The Defendant’s KRW 79,276,410 among the Plaintiff and KRW 65,769,860 among the Plaintiff, shall be KRW 13,387,170 from November 28, 2018.
Reasons
1. Examining the purport of the entire pleadings in the evidence Nos. 1, 3, and 5 as to the cause of the claim, the Plaintiff and the Defendant concluded a lease agreement (hereinafter referred to as “instant lease agreement”) on January 30, 2016 with respect to the fourth floor (hereinafter “instant building”) among the ground buildings of Changwon-si, Changwon-si, the Plaintiff owned on January 30, 2016, the lease deposit amount of KRW 30,000, the period from March 7, 2016 to March 6, 2019 (36 months), the rent of KRW 2,200,000, and the special terms and conditions: The rate of delay delay delay damages for more than two months is 5% per month; the lease agreement was concluded (hereinafter referred to as “instant lease agreement”); the remainder of KRW 19,000, KRW 360, KRW 50, KRW 250, KRW 3605, KRW 250, KRW 360, KRW 1985, KRW 2505.
Therefore, barring any special circumstance, the Defendant agreed to pay the Plaintiff the rent of KRW 77,00,00 for 35 months from April 7, 2016 to March 6, 2019 (i.e., monthly rent of KRW 2,200,000 x 35 months) from April 7, 2016 to October 6, 2018 (i.e., monthly rent of KRW 2,200,000 from April 7, 2016 to October 6, 2018 (i.e., monthly rent of KRW 2,20,000 x 30 x 30 x 30 x 12,787,500 x 30 x 30 x 15% of the late rent of KRW 25% from October 16, 2018).
The basis for calculation is attached Form 109,276,410 won in total of KRW 19,48,910 in unpaid management expenses (i.e., KRW 12,787,50 in total of KRW 77,00,000 above above KRW 19,48,910 in total) and KRW 79,276,410 in remainder after deducting KRW 30,000 in the lease contract of this case at the Plaintiff’s request (i.e., KRW 109,276,410 in total of KRW 30,00 in the above lease deposit - KRW 30,769,860 in the above lease deposit and KRW 65,769,860 in the complaint of this case from November 28, 2018 following the date of delivery of a copy of the complaint of this case, and the claim of this case is claimed.
