A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 성폭력범죄의 처벌 등에 관한 특례법위반( 성적 목적 공공장소 침입) 피고인은 2018. 3. 1. 00:45 경 대전 대덕구 C 상가 내 2 층 여자 화장실에서 성적 욕망을 만족시킬 목적으로 볼일을 보는 여성의 신체 부위를 촬영하기 위하여 시정되지 않은 화장실 출입문을 통해 그 곳 화장실 안까지 들어가 침입하였다. 2. 성폭력범죄의 처벌 등에 관한 법률위반( 카메라 등 이용촬영) 피고인은 제 1 항 기재와 같은 일시 및 장소에서 피해자 D( 여, 28세) 이 용변을 보고 있는 용변 칸 옆 칸에 들어가 휴대폰 카메라의 동영상 촬영기능을 작동시킨 다음 용변 칸 위로 위 휴대폰을 집어넣어 피해자가 용 변보는 모습을 몰래 동영상 촬영하려고 하였으나 이를 눈치 챈 피해자에게 발각되는 바람에 그 뜻을 이루지 못하고 미수에 그쳤다.

The punishment as ordered shall be determined by taking into consideration all the circumstances, such as the defendant's age, sex, environment, motive, means and consequence of the crime, and circumstances after the crime, in light of the following circumstances, for the protection and observation, Article 62-2 of the Criminal Act, Article 16(2) of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes:

Unfavorable circumstances: The crime is not good to have taken pictures that may cause a sense of sexual shame by harming the public use site for sexual purposes, and the circumstances favorable to the denial of the crime at the initial stage of the investigation: the confession is being divided while making a confession.
