A defendant shall be punished by imprisonment with prison labor for not more than ten months.
Reasons
Punishment of the crime
[criminal history] On July 20, 2017, the Defendant was sentenced to a suspended sentence of two years on July 28, 2017 to six months of imprisonment for criminal fraud at the Suwon District Court Sejong District Court members, and the said judgment became final and conclusive on July 28, 2017.
[2] The Defendant, “2017 Highest 1889, the Defendant,” who leased and used the E digging machine from D, was able to borrow money by providing it as if he/she was the owner of the said digging machine and as security.
1. On November 2015, the Defendant: (a) entered the construction machinery registration number column of the construction machinery transaction agreement signed in D in the name of around November 17, 2014; and (b) recorded the column “E” at the same place with a straw-shaped pen made of the column “E” using a straw-shaped pen.
Accordingly, for the purpose of exercising, the Defendant forged one copy of the construction machinery transaction contract in the name of D, a private document on rights and obligations.
2. On November 5, 2015, at G’s office located in Suwon-si, Suwon-si, the Defendant presented a “contract for the sale of construction machinery” to the victim H, stating that “The Defendant shall lend KRW 10,000,000,000,000,000,000,000,000,000 won, to be provided as security for the locker” to the victim H.
However, in fact, E excavation was not owned by the defendant because the defendant leased from D, and the above sale contract was forged by the defendant's arbitrary entry of "E" after inserting the registration number column of construction machinery in another construction machinery transaction contract.
Nevertheless, the defendant deceivings the victim as above and was given 10 million won on the same day from the victim as the borrowed money.
Accordingly, the defendant exercises forged private documents and received property by deceiving the victim.
No person of "2018 Highest 436" shall dump any commercial wastes in any place other than a place or facility prepared by a competent authority for the collection of wastes.
