A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
The Defendant was working as a director of the E-site site in the Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, which is promoted by C. As a result, the Defendant agreed with C to make an investment in the said E-project and raised funds to make an investment in the process of raising funds to be invested, the Defendant was willing to receive loans using the number plate without any body and the construction machinery registration ledger.
1. On December 30, 2013, the Defendant: (a) purchased two of the F and G excavation search machine board on December 30, 2013; and (b) submitted an application for the establishment of a right to collateral security with the content of a purchase contract with FJ from H at the above construction site office located in the Dansan-gun, Chungcheongnam-gun, Chungcheongnam-do on December 30, 2013; and (c) provide the above excavation search machine as collateral; and (d) KRW 45 million with interest; and (d) with interest 14.9% per annum; and (e) with interest 36 months until December 15, 2016 with equal repayment of the principal and interest on a 36-month basis; and (e) attached the said application to the above loan by photographing a numberless excavation machine on the part of the said construction site as if there exists a real excavation machine.
However, there was no value as a collateral because there was no difference between the number plate and construction machinery register and there was no difference in body.
The defendant deceivings the victim company as above and thereby acquired 45 million won by receiving 45 million won from the victim company as a loan.
2. On January 24, 2014, at the same place as Paragraph 1, around January 24, 2014, the Defendant: (a) drafted an application for a loan on the terms and conditions of equal repayment of principal and interest between 40 million won and loans; (b) interest 14.9% per annum; and (c) and 36 months until February 10, 2017; and (d) submitted the said application for the loan to the Bank Bank (HK) Savings Bank (HK) by deeming that there exist actual excavations.
