Punishment of the crime

1. Defendant A and G, H, I, J, and K Joint Crimes (Violation of the Electronic Financial Transactions Act) committed in China (a public offering) and H and G, as the total liability of the so-called “Spanishing organization operating in China,” Defendant A and G conspired to divide the amount of damage deposited in the relevant financial account by sending text messages to many unspecified people and securing access media such as the physical cards acquired therefrom to receive criminal proceeds from the Spanishing, with intent to keep the amount of damage deposited in the relevant financial account due to the Spanishing, by recruiting the cards collection books and cash withdrawal books, by dividing the amount of damage deposited in the relevant financial account as the head of the team, Defendant A, as the head of the team, Defendant B, by dividing the amount of damage caused by J and K, and by dividing it as the source of the remittance team, and by dividing it into part of the profits acquired therefrom.

이에 따라 피고인 A는 M 및 G이 중국제 모바일 메신저인 ‘ 위 챗 ’에 개설한 채팅 방에 ‘L’ 이라는 아이디로 가입하여 위 M 및 G의 지시에 따라 자신이 수거한 체크카드를 I의 팀원인 J과 K에게 전달하고 그 대가로 일당 15만 원을 받기로 하고, 2017. 4. 29. ~5. 1. 경 중국에 입국하여 I의 소개로 M과 G을 만 나 위 공모와 같이 범행하기로 모의하였다.
