Reasons
Punishment of the crime
On December 3, 2010, the Defendant was sentenced to six months of imprisonment for fraud at the Seoul Central District Court on December 3, 201, and completed the execution of the sentence at the Seoul Detention Center on December 29, 2010.
1. The Defendant, 2012No. 2222, who was employed as a delivery facility to the delivery restaurant, did not deliver the collected money to the restaurant proprietor while delivering food, with the intent to flee and consume it as living expenses, etc.
around August 5, 2011, the Defendant was employed as the delivery source of the victim D'E's "E" restaurant operated by the victim D in Eunpyeong-gu Seoul, Seoul, and was engaged in the food delivery and the collection of the price of the above restaurant, and was in charge of the food delivery and the collection business of the above restaurant, on August 6, 2011, the Defendant stored KRW 174,000 for the victim's business and voluntarily consumed the food price of KRW 174,00 for the victim and then, around that time, the Defendant escaped from the business and voluntarily consumed the food price in the Seoul
From around that time to October 2, 2012, the Defendant embezzled the victim’s property in his/her occupational custody by escaping and consuming 2,309,500 won by the same method from the 18th place in Seoul Metropolitan City, such as the first list of crimes in attached Form 1.
2. The Defendant, around July 9, 2011, employed the victim G in Songpa-gu Seoul as the delivery source of “H” Chinese restaurant operated by the victim G in Songpa-gu Seoul, and was engaged in the business of delivering food and collecting the price of the above restaurant, around 15:10 on July 10, 201, paid 30,000 won to the victim under the name of the Defendant’s name of the mother money (hereinafter “shot money”), and 191,500 won for the victim’s food, and voluntarily consumed it from the members of the Si of Seoul Metropolitan City around that time.
From around that time to July 12, 2012, the Defendant embezzled the victim’s property in his/her occupational custody by escaping and consuming it with the same amount of KRW 1,402,00 in nine times from the place of the city in Seoul, as shown in the second list of crimes.
