1. Occupational embezzlement;
A. The Defendant, from March 15, 2013 to the 17th day of the same month, was engaged in the delivery and collection of food of the said restaurant as the delivery personnel of the said restaurant, as the victim D in Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si.
At around 16:00 on March 17, 2013, the Defendant: (a) received one food delivery package from the victim; (b) delivered food to the victim; and (c) received food charges of KRW 330,000,000 from the victim; and (d) embezzled the food charges from the victim at his/her own expense; (b) around that time, the Defendant went away from the above Oralba, thereby arbitrarily consumed the food charges with daily living expenses, etc.; and (c) embezzled the above Oralba, by failing to return it.
B. On March 2013, 2013, the Defendant was engaged in the delivery and collection of food of the said restaurant as the delivery personnel of the “I” Jung Tran restaurant operated by the Victim HH in Suwon-si G, Suwon-si.
around 04:00 on March 2013, the Defendant embezzled cash of KRW 300,000,000, which was collected by delivering food at the above restaurant, for the said victim’s business. Around that time, the Defendant arbitrarily consumed the cash of KRW 300,00,00 from the day in Suwon City as daily living expenses, etc.
C. The Defendant, from April 6, 2013 to August 8, 2013, was engaged in the delivery and collection of food of the said restaurant as the delivery personnel of the “L” restaurant operated by the victim K in the Gangnam-gu, Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu.
At around 15:40 on April 8, 2013, the Defendant: (a) received one food delivery package from the victim’s victim, and delivered food to the victim; and (b) received food charges of KRW 200,000; and (c) embezzled by failing to return the above food charges to the victim at his/her own expense, etc.
