A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On January 9, 2019, the Defendant was released from the detention house on July 30, 2019 and completed the execution of the above sentence on August 3, 2019.

[2019고단1797] 피고인은 2019. 10. 29. 14:48경 평택시 B에 있는 건물 2층에 있는 ‘ ’ 식당에서 ‘손님이 술값을 주지 않고 휴대폰을 던지며 행패를 부린다’는 내용으로 112 신고를 받고 출동한 평택경찰서 C지구대 소속 순경 D로부터 ‘술값을 지불하고 귀가하라’는 말을 듣자, D에게 “짹짹거리지 마라, 죽여 버린다”라는 등 욕설을 하며 머리로 D의 몸을 수회 들이받는 등 폭행하였다.

As a result, the defendant interfered with the legitimate execution of duties of police officers concerning 112 reports.

1. On October 20, 2019, the Defendant: (a) 06:34, around the entrance of the F1st floor in Seocho-gu Seoul Seocho-gu, the Defendant: (b) under the influence of alcohol to the victim G (Nam, 52 years of age) who is an employee of the Seocho-gu Seoul, without any particular reason, used the victim’s face “Woo” to put the victim into the right drinking; (c) display the victim’s neck; (d) flading the victim’s body; (e) flading the victim’s body with his head; (e) flading the victim’s back part; (e) flading the victim’s face; and (e) assaulting the victim’s H (Nam, South and 38 years of age) who restrains this.

2. On October 20, 2019, from around 03:50 to 06:40, the Defendant: (a) sought in the above club operated by the victim H; (b) prevented customers from suffering from the influence of alcohol without any particular reason; (c) booming employees working at the entrance of the club while taking a bath; and (d) obstructed the victim’s duties by assaulting employees who control the Defendant as described in paragraph (1) and obstructing the victim’s duties by force.

3. On October 20, 2019, the Defendant committed the crime of assaulting at the police box located in Seocho-gu, at around 07:14, as described in paragraph (1).
