피고인은 2015. 8. 20. 00:30경 전남 화순군 B 앞 도로에서 자신의 장모에게 큰소리로 욕설을 하는 등 소란을 피워 가정폭력 신고를 받고 출동한 화순경찰서 C지구대 소속 경사 D과 경위 E이 피고인의 양팔을 잡아 택시에 태워 귀가시키려하자 "야 이 개새끼야, 뒤져볼래"라고 욕설하면서 발로 위 D의 오른쪽 다리 부위를 2회 걷어차고, 공무집행방해죄의 현행범인으로 체포되어 위 C지구대 주차장에 도착한 후 C지구대 소속 경사 F가 피고인을 순찰차에서 끌어내리려 하자 위 F에게 "야 이 개새끼야, 씨발놈아"라고 욕설하면서 발로 F의 오른쪽 허벅지 부위를 1회 걷어찼다.
