A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
On April 10, 2019, the Defendant posted a false statement to the effect that, at a place not known by April 10, 2019, 2019, he/she visited B “C” (and without intent or ability to sell gas bC) bags and sold them. The Defendant received KRW 140,000 from the victim to E account in the name of the Defendant on the same day, and received KRW 140,000 from the victim to August 25, 2019, the Defendant received KRW 3,095,000 in total from the victims to the Defendant’s account in the name of the Defendant as indicated in the attached Table of Crimes (1).
On August 25, 2019, the Defendant posted a false letter stating that he/she will sell Dason’s Dason Dason Damp to B “C” page without any intent or ability to sell Dason Doz, and that he/she would send money to the victim F who reported and contacted Dason Doz,” and that he/she received KRW 150,000 from the victim’s account in the name of the Defendant on the same day.

On June 10, 2019, the Defendant sold online goods posted a letter stating that “The Defendant will send back the money to the victim K, who reported and contacted the sales of the money, by accessing the Round to B “C” Kap, without intention or ability to sell the Round in the Mocheon-gu Macheon-dong, Daegu-gu Macheon-dong, where the trade name cannot be known.”
