1. The Defendant’s KRW 34,182,750 for the Plaintiff and KRW 5% per annum from September 19, 201 to February 5, 2015.

1. Basic facts

A. On April 19, 201, the Plaintiff and the Plaintiff entered into a term deposit contract with the Bank of Eas Savings and the Bank of Eas Savings (hereinafter “Eas Savings Bank”) with the term deposit amount of KRW 220 million, the term of contract of KRW 15 million, the interest rate of KRW 5.68% per annum, and the term deposit contract on July 19, 2012 with maturity of KRW 2220 million per day (hereinafter “the term deposit contract of this case”).

B. The Defendant prepared an audit report on the financial statements of the ES Savings Bank (hereinafter “instant audit report”) and prepared an audit report on the 38th period (from July 1, 2008 to June 30, 2009) and 39 (from July 1, 2009 to June 30, 2010) of the said savings bank as an external auditor of the ES Savings Bank under the Act on External Audit of Stock Companies (hereinafter “ External Audit Act”). The said audit report contains an adequate statement on the purport that “The financial statements of the ES Savings Bank are properly indicated in terms of its importance in accordance with the generally recognized accounting standards in the Republic of Korea.”

C. On September 18, 2011, the Financial Supervisory Service’s business suspension and bankruptcy procedure 1) The Bank of Korea’s equity capital ratio on risk-based assets to the Bank of Korea (hereinafter “BISD ratio”) pursuant to the Bank of International Settlements’s standards.
