1. Basic facts

A. On December 15, 2010, the Plaintiff entered into a contract for construction works between the Plaintiff and the Nonparty Jeonnam-do (Road Safety Management Office) for the structural improvement project (hereinafter “instant construction project”) between the Plaintiff and the Nonparty Jeonnam-do (Road Safety Management Office).

As to the Plaintiff, the Plaintiff entered into a contract for construction works with the total construction cost of KRW 1,765,869,00 (including value-added tax) and the total construction period from December 21, 2010 to December 19, 2013. However, the Plaintiff entered into a separate contract with the Plaintiff for the 123th portion of the instant construction work within the budgetary limit of Nonparty Jeonnam-do. Accordingly, the Plaintiff entered into a separate contract with the Plaintiff for the 123th portion of the instant construction work as described in Table 1, and the construction cost, the final settlement of which was completed after the completion of the instant construction work, was total of KRW 2,413,836,00 (including value-added tax).

On December 15, 2010 through December 19, 2010, the first 3rd 203rd 20.3rd 20, 203rd 3rd 20, 203rd 20,36,545,000 of the first 20th 3rd 203rd 20,63rd 203rd 20,36,545,00 of the last 203rd 203rd 20,201, 206th 20, 203rd 20,36,40,000 of the first 20th 3rd 203rd 20,201, 206th 71,60,60th 20,60th 20,206 to 216,206th 20,2016 of the contract.

B. On January 201, the Plaintiff entered into a subcontract between the Plaintiff and the Defendant Pyeongtaek Construction Co., Ltd. (hereinafter “instant subcontract”). Around January 201, the Plaintiff entered into a contract to collectively subcontract the instant construction with the Plaintiff, setting the total construction cost of KRW 1,214,97,50 (including value-added tax) and the total construction period from December 21, 201 to December 19, 2013 (hereinafter “instant subcontract”).
