A defendant shall be punished by imprisonment with prison labor for not more than ten months.
However, the execution of the above sentence shall be suspended for three years from the date this judgment became final and conclusive.

Punishment of the crime

1. On August 2018, the criminal defendant against the victim B made a false statement to the effect that he/she had access to the Internet website C and posted by the victim B, and that he/she would deposit KRW 5,000 in the face of sending the baby to the victim by contact with the victim.
However, the defendant did not have the intention or ability to send money even if he was guilty of the victim.
The Defendant, as above, by deceiving the victim as above, was delivered from the optical bus terminal as hand freight around August 12, 2018 by the victim.
Accordingly, the defendant received property by delivering the victim.
2. Around April 16, 2019, the Defendant: (a) sent a false statement to the victim D, stating that “I will deliver goods upon deposit of money” by accessing G, an Internet site, at the Defendant’s residence located in Magyang-si EF; and (b) contacted the victim with the victim and posted the victim D.
However, even if the defendant received money from the victim, he did not have the intention or ability to send the goods.
Around April 16, 2019, the Defendant, by deceiving the victim as above, was transferred KRW 40,000 as the price for goods to the International Bank Account (J) in the name of the Defendant’s spouse, around April 16, 2019.
Accordingly, the defendant was given property by deceiving the victim.
The Defendant, on May 23, 2019, connected to G bulletin boards at the above Defendant’s house on May 23, 2019, posted an advertisement advertisement on the sale of the said goods, even though he/she did not intend or have an ability to sell “ero-ray play,” and 30,000 won from the victim’s M&C account (N) in the same day as if he/she sold the said article to the victim K as if he/she had conspiredd with the victim to sell it; and 60,000 won from the victim’s bank account in the same manner as in May 31, 2019; and June 5, 2019.
