Punishment of the crime

Around December 2, 2014, the Defendant posted a false statement stating that “The Defendant shall purchase a musical performance ticket” by accessing NAVV Internet camera (htp:/www. cafe.naver.com/joint venture/joint venture) to the victim, and then sent a false statement to the victim that the Defendant would deliver the goods if he/she would contact the victim as a mobile text message and make a prior payment.

However, since the defendant did not have the above goods, even if he received deposits from the victim, he did not have the ability or intent to sell the above goods.

Nevertheless, the Defendant received 300,000 won from the victim, namely, the Agricultural Cooperative (O) in the name of the Defendant, as the price for the goods.

Accordingly, the defendant was given property by deceiving the victim.

On December 7, 2014, the Defendant “2015 Highest 671” sent by the victim P by accessing the Internet site Niberian, saying, “I find out the part of the main office for the transfer of the table of Gwangju Q compound on December 20, 2014,” and said, “I will send the list of Q Q compound to the victim if I would deposit KRW 143,000 to the company account.”

However, the Defendant did not have any intention or ability to send the above admission tickets even if he received money from the victim because he did not have an admission ticket.

Nevertheless, by deceiving the victim as such, it acquired 143,00 won from the victim to the corporate bank account under the name of the victim.

Around August 21, 2014, the Defendant sent a false statement to the victim R, “I will purchase her prior to the Internet page,” and the Defendant sent a written notice to the victim by communicating the victim with a mobile phone text message to pay KRW 70,000,000 to the victim.
