A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
1. From March 10, 2014, the Defendant embezzled at the E convenience store operated by the victim D in Seongbuk-gu, Sungnam-si, as an employee, with three copies of cultural products worth KRW 15,000 at the victim’s sunset market at the above convenience store around April 4, 2014 while managing and keeping the products of the above convenience store for the victim.
2. On April 9, 2014, the Defendant attempted fraud: (a) around 01:15, 201, entered the victim G, an employee of the victim G, who was the victim D, another store operated by the victim D in Seongbuk-gu, Sungnam-si, and (b) falsely stated that “I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am I am.
3. At night, on April 9, 2014, the Defendant: (a) opened and intruded a dormitory of H University located in Sungnam-si, Manam-si; (b) opened a door-to-door door-to-door door-to-door door-to-door door-to-face-to-door door-to-door door-face-to-door door-on; and (c) cut off a cash of KRW 40,000 on the part of the victim on his/her face-to-face, and a copy of a oneSK card in the name of the victim.
4. Fraud and violation of the Specialized Credit Finance Business Act;
A. On April 9, 2014, the Defendant: (a) around the Gangnam Station located in Seocho-gu, Seoul; (b) presented the said card to a victim’s name-free taxi engineer, and had the victim settle KRW 13,660, 13,660, as if he/she were the legitimate right to use the said card, and used the stolen debit card; and (c) obtained pecuniary benefits equivalent to the amount of KRW 13,660 from the victim by being provided with transportation services equivalent to KRW 13,660.
B. On April 9, 2014, at around 04:56, the Defendant stolen the victim’s name-free taxi engineer from the road near the building zone in Gwangjin-gu Seoul Special Metropolitan City.
