A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

[2014 Highest 8234] The Defendant, by advertising the victim’s card, has used the victim’s card in a singinging line and having knowledge of the credit card password C of the person interested in the singing book he/she works, and had the victim gain a return.

1. Around March 11, 2013, the Defendant violated the thief and Specialized Credit Financial Business Act: (a) posted one of C’s 1SK credit cards, which he had been in possession, and then released 700,000 won as cash service items by inserting the secret number, which he had been aware of in advance, at the 1425-15, Y 1425-15, Seoul Special Metropolitan City, Y-dong 1425-15; and (b) then withdrawn 39,300,000 won in total from the above date to June 4, 2013, and used the lost credit card.

2. On March 14, 2013, the Defendant violated the Fraud and Specialized Credit Financial Business Act: (a) presented at the convenience store near the Defendant’s officetel located in Gwanak-gu, Seoul Special Metropolitan City, oneSK credit card, as described in paragraph (1), to the employee’s name, and paid off the amount of 10,90 won at the market price, and received goods or services equivalent to the total amount of 1,101,860 won from the above date to May 31, 2013, and used the lost credit card.

3. On April 8, 2013, the Defendant violated the Computer, etc. Fraud and the Specialized Credit Financial Business Act: (a) input of C’s Samsung Credit Card Co., Ltd., which was previously possessed by C and was known in advance, at the Defendant’s new forest station located in the Gwanak-gu, Seoul Special Metropolitan City, 1425-15, 5,000 won by inserting the victim’s Samsung Credit Card at the victim’s Hyak-gu, Seoul Special Metropolitan City, 1425-15.
