The prosecution of this case is dismissed.

1. On July 24, 2013, at around 13:55, the Defendant, within the office of the C Center located in Chungcheongnam-si, Chungcheongnam-si, expressed the victim E (e.g., 51 years of age) a large amount of desire to “the year in which water return cannot be returned for the same year” to “the year in which water return cannot be returned for the same year.” On the same day, at around 16:10 on the same day, the Defendant sexually insultingd the victim by “the victim (e.g., whether he will grow up until the opposite day of the year in which he was sick, and whether he will grow up until the opposite day of the same year, the same year in which he was sick.”

2. The grounds for dismissing the prosecution of this case are the crimes falling under Article 311 of the Criminal Act, which can be prosecuted only when the victim files a complaint pursuant to Article 312(1) of the Criminal Act. According to the records, the facts can be acknowledged on May 28, 2014, which are after the institution of the prosecution of this case. Thus, the prosecution of this case is dismissed pursuant to Article 327(5) of the Criminal Procedure Act.
