The prosecution of this case is dismissed.

1. Around September 22:10 on September 12, 2015, the Defendant, at the bus stops in front of Songpa-gu Seoul Metropolitan Government, insulting the victim by openly insulting the victim by speaking the victim as “trings and spaws” in the presence of 2-3 persons waiting for buses, etc., in the face of the victim C(32 years of age) and parking problems.

2. The facts charged in the instant case are those falling under Article 311 of the Criminal Act, and can be prosecuted only when the victim files a complaint under Article 312(1) of the Criminal Act.

However, according to the trial records of this case, it can be recognized that the victim revoked the complaint against the defendant on November 19, 2015 after the public prosecution of this case was instituted. Thus, the public prosecution of this case is dismissed pursuant to Article 327 subparagraph 5 of the Criminal Procedure Act.
