피고인은 2011. 12. 15경 피고인이 거주하던 인천 계양구 B빌라 5-301호에서, 웹하드 파일함(www.fileham.com) 사이트에 아이디 'C', 닉네임 'D'로 접속하여 현금으로 환전하거나, 같은 파일함 사이트 안에서 파일을 다운로드할 수 있는 포인트를 얻기 위해, '(ㄴㅁ)클리베이지 1 2화! ㄱㄱ싱 '이라는 제목의 교복을 입은 청소년의 표현물이 출현하여 성교 행위를 하는 일본 애니메이션을 업로드하고, 업로드 된 파일을 2012. 10. 8까지 불특정 다수의 파일함 회원들이 다운로드할 수 있도록 공유하여 아동ㆍ청소년이용음란물을 배포하였다.

피고인은 같은 일시, 장소에서 같은 방법으로, 전 '가'항의 아동ㆍ청소년이용음란물과 '(ㅇㅁ)아가씨는 H를 좋아해 1 2부 ㄱㄱ!'라는 제목의 남녀가 출현하여 성교 행위를 하는 일본 애니메이션 등 총 2편의 음란 영상물을 정보통신망을 통하여 배포하였다.
