Reasons
Punishment of the crime
1. Defendant A and Defendant C are the field manager of Company B as the representative director and the field manager of Company B from July 2012, 201, who was awarded a subcontract for the construction of the F Building in Chungcheongnam-do, Chungcheongnam-do, Chungcheongnam-do, and Defendant C is the site manager of the “F building construction work” to be performed under a contract from Company B from February 2012 to the said place.
With respect to the construction of the above F building to B corporation, Defendant A is the representative director and the field manager of B corporation who employs the victim H (58 years of age) and Defendant C was responsible for the field safety management. Defendant C was responsible for the field safety management while supervising Defendant A as the site manager of D corporation.
Therefore, the Defendants, as an opening room, have a strong structure with sufficient strength to protective measures such as safety lines, fences, covers, etc. at a place where workers might fall down in the course of their work. In the case of installing a cover, the Defendants have a duty of care to indicate that it is an opening room so that workers may fall down in the course of their work and prevent accidents that may fall during their work.
Nevertheless, the Defendants carried out construction without installing safety railings, etc. as above. On October 16, 2012, at around 20:00, the Defendants got the victim to die from the floor below 10.6 meters away from the upper floor of the second floor, the second floor of the building, which was frighted by cutting down, sitting down, and fright concrete bed, while the Defendants were doing so, they cut down on the floor below the upper floor below 10.6 meters long, and caused the victim to die.
After all, Defendant A shall take necessary measures to prevent the danger at a place where workers might fall during work.
