A defendant shall be punished by imprisonment for not less than one year and six months.

However, the defendant shall be sentenced to the above punishment for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. 특수공무집행방해치상 피고인은 2013. 11. 22. 22:25경 공주시 금성동 금강교 남단 앞길에서 C 카니발 승용차를 운전하던 중, 전국 일제 음주운전 단속근무를 하고 있던 공주경찰서 D지구대 소속 경사 E이 음주 여부를 확인하고자 음주감지기를 불 것을 요구하자 부는 시늉만을 하고, 이에 위 E이 운전석 유리창 안으로 음주감지기를 넣어 재차 음주측정을 요구한 상태임에도 유리창을 갑자기 올리며 출발하여 E의 손을 유리창 안에 끼운 채 약 10m를 진행하고, 이어 E이 손을 빼내자 그대로 진행하여 E의 오른발 부위를 운전석 쪽 뒷바퀴로 역과하였다.
