1. The defendant shall be punished by imprisonment for a year and six months, and a fine of thirty million won;

2. The defendant does not pay the above fine;

Punishment of the crime

[2014Kadan61] On July 17, 2013, the Defendant inserted an article that sells a mobile phone on the Internet’s bulletin board, a trading site of secondhand goods, and agreed to send money to the victim D who reported and contacted the article first.

However, the defendant did not have any goods that he/she would send to the victim, and because he/she is expected to use the money from the victim for his/her own living costs, there was no intention or ability to send the goods to the victim.

On July 17, 2013, the Defendant, by deceiving the victim, received 234,500 won from the victim to the post office account (F) account in the name of E, the Defendant’s seat on July 17, 2013, and acquired it by deceiving each victim over 31 times in the same manner as indicated in the attached list of crimes (1) and acquired it by deceiving each victim in the same manner, such as in the attached list of crimes (1).

[2014 Highest 81] On November 7, 2013, at a place where a place in Seoul is unknown, the Defendant put a letter on the Internet used goods trading site, and then sent money to the victim H who reported and contacted with it, the Defendant first intended to send the goods.

However, the defendant did not have any goods that he/she would send to the victim, and because he/she is expected to use the money from the victim for his/her own living costs, there was no intention or ability to send the goods to the victim.

As such, the Defendant, by deceiving the victim, received 80,000 won from the victim to the corporate bank account (I) in the name of the Defendant on the same day, and acquired it, and also, by deceiving each victim in the same manner over 13 times as shown in the attached Table of Crimes (2), shall receive the total sum of 1,230,000 won from the victim to the above account in the name of the Defendant.
