Defendant shall be punished by imprisonment with prison labor for six months and by a fine of 1,500,000 won. If the Defendant fails to pay the above fine, the Defendant shall be confined in the workhouse for a period calculated by converting KRW 100,000 into one day.

Criminal facts

On August 31, 2010, the Defendant was sentenced to eight months of imprisonment for a violation of the Game Industry Promotion Act at the Seoul Northern District Court, and completed the execution of the sentence on January 14, 201.

The Defendant, upon receipt of a proposal from D who operates a c'C' in the name of "Vietetet Mandong", was responsible for performing duties against Korean tourists, and thereby accepting D's work as seller as above. 그리고 피고인은 H 등을 사육장으로 데리고 가고, 성명불상의 베트남인은 우리에 갇혀 있는 국제적 멸종위기종인 반달가슴곰을 마취 총으로 마취한 후 반달가슴곰을 수레에 신고 사무실에 들어와 초음파 기계로 곰 쓸개 위치를 확인하고, 긴 바늘을 반달가 슴곰 가슴에 찔려 호스로 곰 쓸개즙을 뽑아 채취한 후 이를 소주에 탄 뒤 시식케 한 후, H에게 5cc 가량이 든 곰 쓸개즙 4봉지를 1,622,767원에 판매한 것을 비롯하여 그 무렵부터 2014. 1. 31.경까지 총 63회에 걸쳐 별지 범죄일람표 기재와 같이 합계 100,417,872원 상당의 곰 쓸개즙을 판매하였다.

피고인은 위와 같이 D 등과 공모하여 의사가 아닌 사람이 의료행위를 업으로 하고, 용기나 포장이 불량하여 보건위생상 위해가 있을 염려가 있는 의약품을 판매하거나 판매할 목적으로 제조하였고, 야생생물이자 동물인 반달가슴곰에 대하여 살아 있는 상태에서 동물의 신체를 손상하거나 체액을 채취하거나 체액을 채취하기 위한 장치를 설치하는 학대행위를 하였다.

형사소송법 제334조 제1항 양형의 이유 국제적 멸종 위기종인 반달가슴곰을 마취한 후 주사기로 직접 반달가슴곰의 쓸개즙을 뽑아내어 판매한 이 사건 범행은 그 범행수법이 잔인한 점, 무면허 의료행위 등으로 인하여 사람의 생명, 신체에 직접적인 위해를 발생시킬 우려가 상당한 점, 피고인은 누범기간 중에 이 사건 범행에 나아간 점 등에 비추어 피고인의 죄책이 무겁다. 다만 피고인이 잘못을 반성하고 있는 점, 피고인은 자수하여 수사를 받은 점, 그 가담정도가 아주 중하지는 않은 점 등을 유리한 정상으로 참작하고, 그 밖에 공범들에 대한 양형과의 균형(주범을 제외한 공범들은 집행유예가 확정되었다), 피고인의 연령, 환경, 건강상태 등 제반 양형조건들을 종합하여 주문과 같이 형을 정한다.
