1. The plaintiff's primary claim and the conjunctive claim are all dismissed.

1. Basic facts

A. From November 2008, the Plaintiff is a company running the brand call taxi call service business (hereinafter “instant call center business”) in Seoul Special Metropolitan City from around November 2008, and the Defendant is also a company (the largest shareholder is a Seoul Special Metropolitan City that received 35% or more shares from the said company), electronic prepayment means (paid card, etc., prepaid card, and one-time transportation card for subway fares), its system operation, electronic payment settlement agency, and other smart cards based on smart cards in order to conduct business related to the construction of a new transportation card system in accordance with the “new transportation card system construction plan” of Seoul Special Metropolitan City around 2003.

B. Around December 2006, Seoul Special Metropolitan City enacted a plan to revitalize brand call taxi, and the Plaintiff’s business candidate selection 1) drafted a “plan to revitalize brand taxi and call taxi by converting subsidies to the call center by directly providing them in order to revitalize the function of call taxi.” 2) Seoul Special Metropolitan City established a plan to revitalize brand call taxi on March 23, 2007, and announced the recruitment of taxi service providers under the 2007-569 of the Seoul Special Metropolitan City public announcement on March 29, 2007.

3) On April 4, 2007, Seoul Metropolitan Government prepared a new brand call taxi operation guidelines and held an explanatory meeting for a new brand call taxi creation project, and the operation standards include the following matters. [New brand call taxi" refers to a call taxi officially designated by Seoul Metropolitan Government, meeting the designation criteria set by Seoul Metropolitan Government, so that citizens can use it in a profound and swift manner.

o “New brand call taxi call center” is an operating entity of a new brand call taxi business officially designated by Seoul Metropolitan Government.
