A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

E is an actual business owner operating a game hall with the trade name of "G Gameland" in the Nam-gu, Incheon, and 202, and provides customers who set up approximately 40 to 50 game machines, such as "SPPP" and "S," and provided the above game machine. Upon receiving the instructions of his own mother E, the Defendant registered as the representative of the above game room and settled accounts in the above game room, and H is an employee who sets up game scores at the request of customers in the above game room and conducts cleaning and hearting, and H is an employee who sets up the game points at the request of customers in the above game room, and I and J are employees who perform cleaning and hearting.

Around April 14, 2016, the Defendant received instructions from E and operated the said game room with employees H, I, and J, and paid 400,0000 points to customers K upon receiving a request to exchange 400,000 points out of the points accumulated in the VIP card, and paid 400,000 won to customers K in cash. From October 21, 2014 to April 14, 2016, the Defendant accumulated 10% of the points obtained from the game machine to the VIP card in which customers enter the game room, and paid them in cash if they request money exchange.

Accordingly, the defendant, in collusion with E, H, I, and J, was engaged in the business of exchanging results obtained through game water.
