피고인은 2016. 7. 8. 08:55경 서울 강남구 C 앞길에서 D(55세), E(여, 50세) 등 다수의 행인들 및 112신고를 받고 출동한 경찰공무원 F, G, H 등이 있는 자리에서 경찰공무원인 피해자 I(53세)에게 “개새끼, 쌍놈의 새끼, 야 씨벌 새끼야, 짭새 좆같은 새끼야”라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
